Recognition of NDIS worker screening clearances in the aged care sector

On 15 June 2021, the Aged Care Legislation Amendment (Requirements for Staff Members and Volunteers) Instrument 2021 was registered. This means that aged care providers that are also registered NDIS providers can now accept an NDIS worker screening clearance for workers in risk assessed roles that support NDIS participants.

These changes remove the dual screening obligations for workers in the aged care and disability sectors.

What this means for registered NDIS providers that are also aged care providers

Residential aged care providers that automatically become registered NDIS providers on 1 December 2020 can accept the following for workers in risk assessed roles supporting NDIS participants:

(1) NDIS worker screening clearance,

(2) police certificate, if it was issued before 1 February 2021 and is still current, or

(3) clearance that meets state or territory transitional and special arrangements.

All other workers will need a police certificate unless they hold an existing NDIS worker screening clearance.

If an aged care provider seeks to engage a current or past employee of a registered NDIS provider, they may request that the registered NDIS provider provide verification of the worker’s NDIS worker screening clearance status. Registered NDIS providers should ensure that the aged care provider has the worker’s consent to contact them and request this information.

If you require more information, please contact the NDIS Commission on 1800 035 544 or at nwsd@ndiscommission.gov.au.
